General

These general terms and conditions (the “General Conditions”) apply when you as a consumer (the “Customer”) place an order via www.dashapears-art.com and related pages, (the “Website”). The agreement is concluded between you and Dasha Pears Photography, company reg. No. 2816853-4 Detailed contact information and other information about Dasha Pears Photography are set forth on the Website. The General Conditions are only applicable to Customers that are consumers. Dasha Pears Photography is based at Maasälväntie 5-9 E 28, 00710 Helsinki, Finland.

Age-limit

The Customer must be a minimum of 18 years old to order via the Website.

Artworks and Authenticity

Dasha Pears Photography guarantees that all the products purchased from the Website are original and authentic works of art. Each artwork is sold hand-signed and numbered with a hand-signed and numbered certificate of authenticity enclosed. A certificate of authenticity proves that the product provided to the customer is an original work of art. Dasha Pears Photography reserves the right to emboss or not emboss the printed artworks with an additional authenticity stamp, as well as to stamp or not to stamp the artworks with an authenticity artist’s stamp. Ready-to-hang pieces sold through the Website may or may not have additional authenticity holographic stickers.

Copyright

The Website and all its content are owned by Dasha Pears Photography. The information is protected by intellectual property and marketing legislation. This means that trademarks, company names, product names, images and graphics, design, layout, and information about products, services, and other content may not be copied or used without the prior written consent of Dasha Pears Photography.

Customer Information

When the Customer places an order, the Customer will be requested to provide some personal data. The Customer confirms that the information provided is correct and complete and is responsible for any errors in the information provided. Information about Dasha Pears Photography’s processing of personal data is set forth in Dasha Pears Photography’s Privacy Policy, which constitutes an integral part of these General Conditions.

Prices and Payment

Each item sold on the Website is listed with a price including VAT. At the checkout, you can see the total price including VAT and shipping. We offer our customers payment through the following payment methods: credit or debit card with Strip or PayPal. For orders with delivery addresses outside European Union, any customs costs and taxes are paid by the Customer. 

Prices for the products on the Website are subject to change without notice. Dasha Pears Photography reserves the right at any time to modify or discontinue the sales (or any part or content thereof) without notice. Dasha Pears Photography shall not be liable to the Customer or any third party for any modification, price change, suspension, or discontinuance of the sales.

Special Offers and Discounts

Dasha Pears Photography may from time to time provide special offers on the Website which may have more favorable conditions than those outlined in these General Conditions. Such conditions will apply for the duration of the special offer and the specific products set forth by Dasha Pears Photography in connection therewith. Dasha Pears Photography reserves the right, at any time, to withdraw such special offers. Upon termination or withdrawal of a special offer, these General Conditions shall apply without any amendments. Any offers on specific products on the Website are valid only for a limited period and until products are sold out.

Orders

All the orders completed on the website are considered confirmed by Dasha Pears Photography unless the Customer is notified about the unavailability of a particular artwork/product within 24 hours after completing the purchase on the Website.

No Withdrawal 

All the items offered on the Website are original limited edition pieces, they are bespoke, each of them is hand-signed and numbered, and produced to custom order made by the Customer. These products are exempt from the consumer's right to cancel the purchase under Finnish Law.

Packaging and Shipping 

The artworks are packed and shipped according to the highest art and archival printing industry standards. The artworks are sent with premium shipping services including, but not limited to UPS, DHL, FedEx, EMS, GSL, Posti Priority (Priority Finnish Post), and are delivered to the Customer’s door. The final details and terms of delivery will vary depending on the shipping provider.

The Customer is free to choose between two delivery methods at completing the checkout: Regular Shipping and Express Shipping. Regular shipping might take up to 14 business days depending upon the shipping address. Depending on the shipping address, express shipping takes about 2 to 5 business days. 

Quality Guarantees

All of the original printed works of art dispatched to the customer are going through several quality control checks both in the printing studios and Dasha Pears Photography’s premises. Therefore the Customer is guaranteed to get artwork of impeccable quality with a life expectancy of over 100 years. Dasha Pears Photography guarantees the use of suitable packaging materials and processes that will ensure that the Customer gets the product intact and in perfect condition.

Product Handling by the Customer

After the package has been delivered it is the Customer’s responsibility to handle the contents with great care and unpack the artwork securely. A pair of cotton gloves is enclosed in every package to make the process easier for the Customer. In case an artwork is packaged rolled in a tube or cardboard box, it is highly recommended that the Customer takes the delivered package straight to the framing service and uses the framing professionals’ help to unwrap an unframed artwork. Replacements

If the Customer receives a package that is clearly damaged and the artworks inside the package are damaged as well as a result of this the Customer will get a replacement at no additional cost. In order to get a replacement the Customer needs to provide Dasha Pears Photography with photo documentation and evidence that the package came damaged. In order to provide a replacement Dasha Pears Photography also needs photo proof of a damaged artwork having been completely destroyed (cut to pieces) by the Customer.

Other

Dasha Pears Photography reserves the right to change all information without prior notice. If a listed artwork has been sold out or proven to be impossible to produce in a certain size desired by the Customer, Dasha Pears Photography has the right to cancel the purchase and refund any amounts paid in advance. Dasha Pears Photography reserves the right to make typographical errors in texts on this website. Dasha Pears Photography also does not guarantee that all images accurately reflect the true appearance of the artworks in terms of color, which largely depend on the quality and type of screen on which the products are viewed.
